Osama A. M. Criminal Legal Security in the Law of Drugs and Psychotropic Substances

Abstract

Legal security in general and criminal security in particular are among the topics that have become the focus of jurisprudence, when it comes to evaluating a specific legal or judicial system or when criticizing the legal rule established by the legislator or applied by the judiciary alike, especially in light of the growing inflation in Preparing criminal legislation that comes to keep pace with developments taking place in the society, or as a result of the abundance of jurisprudence and interpretations that prompt the search for clarification of the ambiguity in some texts and the resulting ambiguity in application.

        Due to the modernity of the Narcotic Drugs and Psychotropic Substances Law No. 50 of 2017, which was enacted by the Iraqi legislator to combat the phenomenon of illicit dealing in narcotics and psychotropic substances that began to spread in Iraq after the events of 2003, we have focused on researching the issue of criminal legal security in the above mentioned law in order to demonstrate the extent of the legislator’s commitment to the foundations and components of the Criminal legal security in this law or not, and the extent of its impact on the quality of the law in achieving its basic goal of combating drug and psychotropic substance crimes.
