دعوى نقل ملكية المركبة في التشريع العراقي ( دراسة تحليلية )

Abstract

The lawsuit to transfer the ownership of the vehicle through the judiciary, is an objective and declarative lawsuit represented in giving the buyer or the owner of the vehicle the right to resort to the judiciary to demand the transfer of the ownership of the vehicle in respect of which a paper or electronic traffic contract is concluded to his name, for reasons beyond his control belonging to the seller, including the seller’s refusal and without a legitimate face Regarding the transfer of the vehicle’s ownership or in the event of its absence, loss, or its travel to an unknown destination and others, and after certain conditions are met, most notably the existence of a traffic contract that meets the form stipulated by law. A second backup way to transfer the ownership of the vehicle in the event that it is not possible to transfer it according to the original route of reviewing the traffic department, and the Iraqi legislator was the only one among the rest of the Arab laws in approving this case.
