Abstract
The development of science has led to the advancement of means of detecting the condition of the fetus while it is in its mother’s womb, and in some cases it is proven to the doctor that the fetus has a congenital defect and malformations, and that it will be born deformed and if it is born and lived it will be a burden on its parents, family and society in general, in addition to the pain he suffers Pains throughout his life. This resulted in a discrepancy in both Islamic jurisprudence, As well as positive laws when it comes to a fetus may be born deformed.
