Abstract

Administration uses several tools to initiate its activities in the area of administrative contracts that are not subject to a single legal regime. There are some contracts which are governed by public law and others governed by private law. It is well -known that the administrative contract in the domain of the public law includes exceptional conditions that are uncommon in the private law. These conditions include the management's authority to supervise and audit the execution and amendment of the administrative contract as well as the authority to impose penalties on the contractor in the case of breaching the contract to force him to perform the work in accordance with the terms of the agreed contract without resorting to the judicial authorities due to its relation to the public order and interest, which is the regular and steady functioning.
