Abbas F. S. Criminal Electronic Surveillance and The Prospects For Its Application in Iraqi Law

Abstract
Electronic monitoring means placing the accused or the convicted person, upon deciding the place of execution of his arrest or confinement at home instead of detention centers or prisons, under the consideration of the competent authorities and following him up on the extent of his compliance with the conditions imposed on him by means of an electronic means and in the cases permitted by the law. States in their national legislation as an alternative to arrest (precautionary detention) or an innovative way to implement a short-term negative sentence at home instead of imprisonment to avoid the convict risks mixing in prisons and save the costs of running the penal institution. In the present research, we tackled the definition and the concept of electronic monitoring and its position in legislation, in addition to the views of its application in Iraqi law. It has been reached to the fact that our country is in need to expedite the introduction of the electronic monitoring system by the Iraqi legislator after preparing its material and human requirements.
